The petitioner, who was arrested and remanded to judicial custody on 01.01.2024, for the offence punishable under Sections 8(c) read with Section 1/4
22(C), 23(c), 25, 27(A), 28 and 29 of Narcotic Drugs & Psychotropic Substances Act, 1985 in connection with C.C.No.547 of 2024 on the file of the learned I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai, seeks bail.
2. The contention of the learned counsel for the petitioner is that the petitioner was arrested on 01.01.2024 and from that day he has been suffering incarceration. He further submitted that the petitioner was travelling in a car with her husband and brother-in-law, who have been arrayed as A5 and A6 in this case and she was seated in the rear side of the car and she has no knowledge about the transportation of the contraband and from her no contraband was seized in person. Hence, he prayed for bail.
3. Mr.N.P.Kumar, learned Special Public Prosecutor for NCB Cases appearing for the respondent submitted that totally 11kgs of Amphetamine was seized from the petitioner and it is commercial quantity. 2/4
4. Considering the fact that the seized contraband is a commercial quantity, this Court is not inclined to grant bail to the petitioner.
