This Writ Petition has been filed seeking a direction to the respondents to consider the representation submitted by the petitioner seeking disbursement of his retirement benefits, such as Gratuity, Provident Fund, Special Provident Fund, Encashment of unearned leave on private affairs, along with applicable interest. 2.Heard the learned counsel appearing on either side and perused the materials available on record.

3.The petitioner was appointed as a Clerk in the second respondent Society. Subsequently, he was promoted to the post of Accountant and thereafter to the post of Secretary. On attaining the age of superannuation, the petitioner retired from service on 31.05.2023. However, the petitioner was disbursed only a sum of Rs.2,50,000/- and the remaining amount of Rs.36,96,607/- towards terminal benefits is still pending. Hence, the petitioner submitted a representation seeking disbursement of the balance amount.

4.On instructions, the learned Additional Government Pleader appearing for the respondents submitted that the petitioner is entitled to receive terminal benefits to the tune of Rs.34,94,524/-, out of which a sum of Rs.2,50,000/- has already been paid. The remaining amount payable to the petitioner is Rs.32,44,524/-. However, it was further submitted that an inspection for the year 2023-2024 was conducted and as per the inspection report, a loss for Rs.1,48,329.46 was noticed. That apart, loan amounts to the tune of Rs.1,60,52,000/- are pending recovery. Therefore, the respondents are unable to settle the terminal benefits to the petitioner. 5.In view of the above, the respondents are directed to disburse the applicable terminal benefits payable to the petitioner within a period of twenty weeks from the date of receipt of a copy of this order. 6.With the above direction, this Writ Petition stands disposed of. No costs.
