This criminal revision case has been preferred against the order dated 19.10.2022 passed in Crl.MP.No.1998 of 2022 on the file of the Judicial Magistrate, Pappireddipatti, thereby dismissing the petition filed for seeking to return a trailer, 2.

Heard, the learned counsel for the petitioner, the second respondent, the learned Government Advocate(crl.side) appearing for the first respondent and perused, all the materials placed before this Court. 3.

On perusal of the records, it is revealed that the petitioner prayed to return a trailer in respect of crime No.119 of 2022 on the file of the Inspector of Police, Pappireddipatti Police Station. However, the trailer sought for by the petitioner has been seized in crime No.361 of 2022 registered for the offences under Sections 447, 431, 434, 353, 506(i) of IPC r/w 3(2) PPDL Act & 3 of Explosive Substance Act, 1908 and handed over to Judicial Magistrate Court, Omalur in CP.No.113 of 2022. Therefore, the learned Judicial Magistrate, Pappireddipatti rightly

dismissed the petition stating that the property was in the custody of another court. As such, this criminal revision case is liable to be dismissed.

Accordingly, this criminal revision case is dismissed. However, the trial court is directed to complete the trial within a period of three months from the date of receipt of this order. Further, subject to the findings at the end of the trial, the trial court is directed to return the vehicle either in favour of the petitioner or in favour of the accused. 14.07.2025 Index : Yes/No : Yes/No Speaking/non-speaking order lok
