O R D E R

The petitioner, who was arrested and remanded to judicial custody on 22.08.2025 at the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 309(4), 311, 351(3) of BNS Act, 2023, in Crime No.324 of 2025 seeks bail. 2.This is the first bail petition. The case of the prosecution is that on 22.08.2025, at about 06.00a.m., while the de-facto complainant was riding his two wheeler, the petitioner along with the co-acused waylaid him and demanded money. When the de-facto complainant refused, the petitioner and the co-accused abused him in filthy language, robbed Rs.1650/- from his pocket at knife point, and assaulted and threatened him. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the offence as alleged by the prosecution. Hence, he prays for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.side) submitted that

the property has been recovered. However, the petitioner has a bad antecedent and is involved in twenty eight previous cases. Therefore, if the petitioner is released on bail, he is likely to commit similar offences.

5. Considering the fact that the petitioner is a habitual offender and has twenty eight (28) previous cases, and though the property is said to have been recovered, releasing the petitioner on bail would not be appropriate. Hence, this Court is not inclined to grant bail to the petitioner, as there is no change in the circumstances of the case. Accordingly, this Criminal Original Petition is dismissed. 13-10-2025 nvi To
