ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.06.2025, for the offences punishable under Sections 309(4) of BNS in Crime No.118 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner along with other accused involved in theft of two wheeler of the defacto complainant. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this cases and he is in judicial custody since 11.06.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that there are totally two accused in this case and the petitioner is arrayed as A1; that the stolen two wheeler was recovered from this petitioner; that the petitioner has 22 previous case and he is a history-sheeter; and that the investigation is pending. 5.

Considering the facts, the previous antecedents of the petitioner and the fact that the stolen two wheeler was recovered from this petitioner, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 10.10.2025 stn To
