PRAYER Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 2nd Respondent herein to dispose of Petitioners Second Appeal in CIC/UTPUP /A/2022/667556-UM on the file of the 2nd Respondent herein within the time frame to be fixed by this Court.

ORDER

(1)Dr.G.Babu, learned Senior Panel Counsel accepts notice on behalf of the 1 respondent and Mr.Ramasamy Meyyappan, learned Government Advocate accepts notice on behalf of the respondents 2 and 3. With the consent of both the learned counsels, the writ petition is taken up for final disposal at the admission stage itself.

(2)The writ petition is filed by the petitioner for a mandamus directing the 1 respondent herein to dispose of the petitioner's Second Appeal in CIC/UTPUP/A/2022/667556-UM dated 16.12.2024 within a time frame to be fixed by this Court.

(3)The petitioner sought for certain information from the 3 rd respondent and for that purpose, she filed a petition on 30.06.2022, under the Right to Information Act, 2005. Pursuant to the petitioner's petition, the 3 rd respondent furnished the information on 26.07.2022. Not satisfied with the information provided, the petitioner filed a First Appeal under Section 19 of the RTI Act, before the 2 nd respondent on 19.08.2022. The First Appellate Authority, passed the order on 23.09.2022, furnishing certain information. As the petitioner was not satisfied with the information provided by the First Appellate Authority, she filed a Second Appeal under Section 19[3] of the RTI Act, before the 1 st respondent on 16.12.2022. On 08.08.

2023, the 1 respondent disposed of the Second Appeal by directing the respondents 2 and 3 to give their updated and detailed revised reply on the information sought for by the petitioner and as a reply to the same, the 3 rd respondent, on 01.11.2023, submitted his reply, providing information as sought for by the petitioner. The petitioner states that pursuant to the order of the 1 respondent dated 08.08.

respondent on 02.11.2023, complaining of the same. As there was no response from the 1 st respondent to the aforesaid letter of the petitioner, the petitioner was constrained to file the above writ petition for the aforesaid relief.

(4)Heard both the learned counsels and perused the materials placed on record. (5)The facts of the case are not disputed. Admittedly, the petitioner's Second Appeal in SA.No.CIC/UTPUP /A/2022/667556-UM dated 16.12.2022 was disposed of by the 1 st respondent on 08.08.2023 with a direction to the respondents 2 and 3 to furnish their updated and detailed revised reply on the information sought for by the petitioner. The petitioner, aggrieved by the insufficient and irrelevant information furnished by the 3 rd respondent, submitted a letter to the 1 st respondent complaining about the same.

(6)Under the facts and circumstances of the case, I am inclined to direct the 1 respondent to consider and pass orders on the petitioner's letter / communication dated 02.11.2023 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

(7)The writ petition is disposed of accordingly.
