ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case, Cr.No.146 of 2015 was registered for the alleged offence under Section 51(a) r/w.63, 52(a) r/w.68, 65 of Copyright Act, 1957 and 511 of IPC. It is stated that in this case, A1 and A3 since died and A2 and A4 have been regularly attending the Court proceedings. The allegation against the Accused in this case is that they were working in a theater and they tried to illegally film for unauthorised copy of the film through camera. For the said allegation, the case is facing the proceedings from the year 2015. There is no previous or subsequent case against the Accused.

3. Considering the nature of the allegation and the accused facing the case since 2015, further continuation of the trial would impinge upon the right to a speedy trial of the accused. Continuing with the case would serve no useful purpose.

shl 4.Accordingly, the case in CC.1407/2021 on the file of the Judicial Magistrate No.II, Coimbatore Taluk, Coimbatore, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
