2.The learned counsel on either side submitted that the issue involved in this writ petition is squarely covered by the order passed by this Court in the case of "C.V.Mathew and Jose Mathew Vs. The Income Tax Settlement Commission and others in W.P.No.5365 & 5364 of 2005".

3.In view of the same, this writ petition is allowed. No costs.
