ORDER
This Criminal Miscellaneous Petition has been filed to modify the condition in para 5(i) imposed by this Court in Crl.R.C.No.1017 of 2025 dated 23.07.2025 as follows :- "5.(i) the petitioner shall deposit the original title deeds not less than the value of Rs.1,50,00,000/- (stands in the name of the petitioner or his relative or friends) along with a proper valuation certificate obtained from the authority concerned to the credit of Crime No.156 of 2024 pending on the file of the respondent police."

The learned counsel for the petitioner submitted that he finds difficulty to deposit original title deeds to the value of Rs.1,50,00,000/-, since the original title deeds were pledged with the bank for the purpose of developing his business and now one of his relative have come forward to give his title deed worth of Rs.50,00,000/-. Accordingly, he filed the present petition praying to modify the condition imposed by this court.

3. The learned Government Advocate (Crl. Side) appearing for respondent would submit that totally five previous cases pending against the petitioner, which are similar cases of Lottery.

Considering both side submissions, the fact reveals that there is no valid ground adduced for modification of the condition imposed by this court on 23.07.2025, as on date, the investigation is also not completed and there are five previous cases viz., Crime Nos. 226 of 2010, 384 of 2012, 130 of 2015, 326 of 2015, 1131 of 2020 and 156 of 2024 registered under the Lottery Act against the petitioner. Therefore, on considering the facts and on seeing the conduct of petitioner, this Court is not inclined to modify the condition, since still the matter is under investigation. Accordingly, this Criminal Miscellaneous Petition is dismissed. Furthermore, if the recovered amount is not deposited in anyone of the nationalised bank, the Trial Court is directed to deposit the amount, which was recovered by the respondent police in anyone of the nationalised bank as per manner known to law.
