This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.S.Ravi Kumar, learned counsel for the appellant in CMA.No.888 of 2025 and respondents 1 to 4 in CMA.No.1119 of 2025, Mr.D.Bhaskaran, learned counsel for the nd appellant in CMA.No.1119 of 2025 and 2 respondent in CMA.No.888 of 2025 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT There are two appeals, one by the claimant and the other filed by the Insurance Company. Pursuant to the orders of this Court, the entire award amount of Rs.15,79,375/- (Rupees Fifteeen Lakhs Seventy Nine
Thousand Three Hundred and Seventy Five only), together with applicable interest has been deposited by the Insurance Company. 2.Today, the parties have arrived at an amicable settlement of Rs.10,00,000/- (Rupees Ten Lakhs only), with interest, awarded by the Tribunal, which the appellants are entitled to withdraw. The remaining amount shall be withdrawn by the Insurance Company. Respective withdrawal/payment out shall be without insisting on any formal petitions. Apportionment will be in the same ratio as awarded by the Tribunal.
st 3.Pending the appeal, the 1 appellant in CMA.No.888 of 2025 has passed away and the cause title has also been amended in that regard. st 4.Insofar as the claim of the 1 appellant in CMA.No.888 of 2025 Vinayagam, who has passed away, pending the appeal, his share shall be equally shared by the other appellants in CMA.No.888 of 2025. 5.The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in
accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. nd Counsel for the 2 respondent This Lok Adalat award is passed in terms of the above settlement.
