ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.08.2025, for the offences punishable under Sections 61(2), 191(2), 191(3), 103(2) and 351(3) of BNS in Crime No.235 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on account of illicit relationship between the petitioner's wife and the deceased person namely Sadiqbasha, the petitioner got enraged and therefore conspired with other accused persons/ A1 and A2 to murder Sadiqbasha; that on 18.08.2025, A1 and A2 taken Sadiqbasha to Koonimedu Beach and they along with other accused jointly murdered Sadiqbasha using various weapons. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this cases and he is in judicial custody since 19.08.2025. He further submitted that the petitioner is not at the scene of occurrence and he is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there are totally five accused in this case and based on the instigation of this petitioner, the other accused had murdered the deceased; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the allegation against this petitioner and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 10.10.2025 stn 3/4
