The impugned order dated 29.08.2025 is only a show cause notice as to why recovery shall not be made against the petitioner, as excess amount has been paid mistakenly by the employer and though three days time was given within which time since no reply has been given and no further order has been passed making the recovery from the petitioner, at this stage the show cause notice since has been questioned, we are not inclined to entertain this writ petition.
2. However, since the date of the show cause notice is 29.08.2025 and three days time given by the respondents is already over and, till date no final order since has been passed according to the learned counsel for the petitioner, we deem it appropriate to give liberty to the petitioner to give reply to the show cause notice dated 29.08.2025. On receipt of such reply, the respondents shall consider the same and pass orders on merits and in accordance with law. If any final order is passed against the petitioner, it is open to the petitioner to agitate the issue in the manner known to law.
3. With the aforesaid liberty, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. (R.S.K.,J.) (H.C.,J.) 20-11-2025
