Respondent Prayer: Criminal Revision is filed under Section 438 r/w. 442 of BNSS, to call for the records in Crl.M.P.No.883 / 2024 in TNRP0E - 000994-2024 on the file of Judicial Magistrate, Walajapet - II and to set aside the same. For Petitioner : Mr. T.Jeyaram For Respondent : Mr.L.Ram Kumar 1/4
Crl.RC.No.379 of 2025
ORDER
This Criminal Revision has been filed as against the order dated 30.09.2024 made in Crl.M.P.No.883/2024 on the file of the learned Judicial Magistrate No.II, Walajapet, Ranipet District, thereby dismissing the complaint filed by the petitioner.
2. On a perusal of the complaint it is revealed that the husband of the respondent initially lodged a complaint as against the petitioner and the same has been registered in Cr.No.688/2019 which culminated into C.C.No.27/2021 on the file of the learned Judicial Magistrate No.II, Walajabad. Subsequently, an another complaint was lodged as against the petitioner for the very same incident. Therefore, the petitioner lodged a private complaint for the offence punishable under Section 211 of IPC. After recording the statements, the trial Court found no ingredients are available in the complaint to make out any offence and dismissed the complaint. Aggrieved by the same, the present criminal revision has been filed.
3. According to the petitioner, the second complaint lodged against him is a false one and no such occurrence has happened. If at all the 2/4
petitioner has any grievance over the complaint lodged by the respondent, he can very well challenge the same in the manner known to law. In fact, in the earlier complaint, the petitioner was convicted and sentenced to undergo three years imprisonment. In order to escape from the clutches of law, the petitioner has filed the present complaint. Therefore, the trial Court has rightly dismissed the complaint filed by the petitioner and this Court finds no infirmity or illegality found in the order passed by the trial Court.
4. Accordingly, this Criminal Revision is dismissed. 13.08.2025 Index : Yes/No : Yes/No Speaking/non-speaking order bkn To:
