(Order of the Court was made by C.V.Karthikeyan, J.) These petitions have been filed seeking to condone the delay of 61 days respectively in filing the above first appeals.
2.The appeals had been filed questioning the preliminary decree of granting partition and separate possession. Since the rights of the parties will have to be determined and the appeal suit is only a continuation of original suit proceedings, the delay stands condoned.
3.Counter had been filed, but however, in view of the fact that the matter relates to within the family, we would condone the delay and the petitions stand allowed. Registry to number the appeals, if they are otherwise in order and print the name of learned counsel for the respondents in the cause list when the appeals are listed for admission.
