ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.143 of 2017 was registered for the alleged offences under Sections 294(b), 332, 353, 506(1) of the Indian Penal Code, and Section 4(1)(j) of TN Prohibition Act. When the police was in regular vehicle checkup, the Accused who was driving the car abused the police and caused damage and threatened the police. For the said allegation, the case is pending from 2017.

3.Considering the nature of allegation, the antecedents of the accused, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served. Page No.1 of 2 https://www.mhc.tn.gov.in/judis

shl 4.Accordingly, the case in STC.400285/2018 of Judicial Magistrate Court, Udhagamandalam Taluk, Nilgiris stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
