The writ petition is filed for a Mandamus, directing the first respondent to consider the representation of the petitioner dated 30.09.2024 and to come forward to execute a termination of lease deal in respect of the lease already registered vide document No.841/1978, dated 29.06.1978.
2. Upon a perusal of the representation as well as the affidavit and upon hearing the Learned Counsel for the petitioner, it is clear that originally a registered lease deed was executed in favour of the first respondent/Corporation. Thereafter, it is the case of the petitioner that thereafter subsequently the lease has been determined and the Corporation has even handed over the vacant position. The only formality that remains to be complied is the execution of the cancellation of the lease deed so that the entry that is still subsisting in the registration be
cleared and the property can be enjoyed by the petitioner without encumbrance.
3. When the matter came up for admission, Ms.D.Hemavathi, the Learned Counsel took notice for the 1st respondent.
4. In view of the limited prayer that is made the writ petition is disposed of at the admission stage itself. In view of the averments that already the lease has been determined and the possession has already been handed over to the petitioner, this writ petition is disposed on the following terms. (i) The first respondent shall duly execute the cancellation letter, receipt or such document as may be required and depute any one of the subordinate Official authorising him to present it before the appropriate SubRegistrar and the same shall be registered. (ii) The above exercise shall be completed within a period of six weeks from the date of receipt of the web copy of the order without waiting for the certified copy of the order.
5. In view thereof, this Writ Petition is disposed of. There shall be no order as to costs.
