This writ petition has been filed for the issue of a writ of mandamus directing the second and third respondents to consider the representations made by the petitioner wherein the petitioner is seeking for returning back the original registered documents registered as Document Nos.2897 of 2009 and 2898 of 2009, dated 24.04.2009.
2. The learned Government Advocate appearing on behalf of the respondents submitted that the registered sale deeds that are sought for by the petitioner pertains to the year 2009 and those sale deeds are not available in the office of the third respondent.
3. The learned counsel for the petitioner submitted that the relevant entries are found in the encumbrance certificate and certified copy has also been given to the petitioner. However, the original registered sale
deed was not handed over to the wife of the petitioner during her lifetime. On her demise, the petitioner made several representations seeking for the original registered documents and the same was not returned back.
4. In the considered view of this court, it is loo late in the day to grant the relief as sought for by the petitioner. The respondents have taken a specific stand that the registered documents are not available in the office of the third respondent. In view of the same, no useful purpose will be served in directing the respondents to hand over the original registered documents.
5. It is left open to the petitioner to make use of the certified copy of the documents if he wants to deal with the property. Except giving this clarity, no further orders can be passed in this writ petition.
