This Habeas Corpus Petition was filed under Article 226 of the Constitution of India to direct the respondents to produce the petitioner's brother/detenu or his corpus namely, Thangamani, aged 50 years, before this Court and set him at liberty forthwith.

This Habeas Corpus Petition has been filed by the brother of the detenu to direct the respondents to produce his brother, viz., Thangamani, aged 50 years, before this Court and set him at liberty.

2. We have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. Learned Additional Public Prosecutor would state that the detenu had borrowed loan from several persons and defaulted in payment and hence, he remains absconding. There is no illegal detention.

4. On perusal of the affidavit, it is seen that even as per the averments made therein, there is no illegal detention. Considering the submission made by the learned Additional Public Prosecutor that there is no illegal detention, we are not inclined to entertain this Habeas Corpus Petition. Accordingly, the Habeas Corpus Petition is dismissed.
