Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 2nd respondent to consider the representation dated 12.09.2025 and to conduct a fair enquiry relating to deletion of names viz., 1.Mannammal, 2.Janaki and 3.Kamala from Joint Patta No.840 regarding agricultural land in Survey No.11/4, Thandarambattu Taluk, Malamanjanur Village, Tiruvannamalai District to an extent of 1 acre 7 cents of land. This writ petition has been filed seeking for issue of a writ of mandamus directing the second respondent to deal with the representation made by the petitioners on 12.09.2025, wherein the petitioners have sought to delete the names of rival parties from the joint patta that was issued in Joint Patta No.840 pertaining to the subject property.

2. Heard the learned counsel for the petitioners and the learned Government Advocate for the respondents 1 to 3.

The case of the petitioners is that the rival parties were attempting to encroach upon the subject property belonging to the petitioners and hence, the petitioners filed a suit for declaration in O.S.No.5 of 2020 on the file of the District Court, Thandarampattu. The said suit was decreed vide judgement and decree dated 30.09.2021. According to the petitioners, this decree has become final. Pursuant to 2/4

the above, the petitioners submitted a representation dated 12.09.2025 seeking for removal of names of rival parties in the patta. Since there was no progress, the present writ petition came to be filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to deal with the representation made by the petitioners on 12.09.2025 on its own merits and in accordance with law, after affording an opportunity of hearing to the petitioners as well as rival parties and final orders shall be passed within a period of eight weeks from the date of receipt of a copy of this order. This Writ Petition is disposed of. There shall be no order as to costs.
