ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.09.2025, for the offences punishable under Sections 123 and 275 of BNS and Section 24(1) of COTPA Act in Crime No.389 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 26.09.2025 in Crl.O.P.No.26845 of 2025.

The case of the prosecution is that on 14.09.2025 at about 05:00 a.m., while the respondent police were on their routine patrol duty, they found that the petitioner was involved in illegal transportation of 205.900 kilograms of banned tobacco products. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 14.09.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that huge quantity of contraband involved in this case; and that the investigation of this case is still pending. 5.

Considering the facts, quantity of contraband involved in this case, there is no change of circumstances after the dismissal of the earlier bail application in Crl.O.P.No.26485 of 2025 and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 16.10.2025 stn 3/4
