ORDER
The present application has been filed to grant leave to sue to institute the suit against the
respondents/ defendants 1, 3 4 & 5 as they are residing outside the jurisdiction of this Hon'ble Court and further respondents/ defendants 2, 6 & 7 are having another address outside the jurisdiction of this Hon'ble Court and one of the property (Item No.2) is outside the jurisdiction of this Court.
2.Learned Counsel appearing for the applicant would submit that the mortgage has been created with respect to A-Schedule property securing the claim made by the plaintiff in the suit is within the jurisdiction of this Court which would amount to a substantial portion of cause of action within the jurisdiction.
3.Upon considering the above submissions and examining the draft plaint and the affidavit filed in support of this Application, the cause of action for this suit has arisen at least partly within the jurisdiction of this Court. Consequently, A.No.550 of 2024 is allowed by granting leave to the applicant as prayed for before this Court.
