Respondent Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider and pass orders on the petitioner's representation dated 02.11.2024 seeking appointment on compassionate grounds in the place of his late father, within a time frame to be fixed by this Court.

ORDER

This writ petition has been filed for direction to the respondent to consider the representation submitted by the petitioner dated 02.11.2024 1/4

seeking appointment on compassionate ground.

The petitioner's father, while working as Senior Factory Assistant in Madhavaram Dairy, died on 25.03.2021 due to sudden heart attack leaving behind his wife, the petitioner and the petitioner's sister and brother as his surviving legal heir. Immediately, the petitioner submitted representation on 01.07.2021 to the respondent seeking employment on compassionate ground. However, it is pending on the file of the respondent without consideration.

On instruction, the learned Standing Counsel appearing for the respondent submitted that the petitioner is qualified with only 9th standard. The minimum education qualification required for appointment on compassionate ground is pass in 12th standard or ITI. As per old by-law, prior to 01.04.2014, the minimum education qualification required for appointment on compassionate ground was pass in 8th standard. However, it is not applicable to the case on hand. Since the petitioner's father died in the year 2021, the present by-law is applicable to the case of the petitioner. Therefore, the application submitted by the petitioner seeking appointment 2/4

on compassionate ground cannot be considered on the ground that the petitioner is not qualified with 12th standard. Therefore, this writ petition is devoid of merits and the same is liable to be dismissed. 4.

Accordingly, this writ petition is dismissed. There shall be no order as to costs.
