PRAYER :- Civil Revision Petition is filed under Article 227 of the Constitution of India, pleased to set aside the petition and order dated 21.08.2024 made in I.A.No.9 of 2024 in I.A.No.3 of 2023 in O.S.No.58 of 2023 on the file of learned District Munsif Cum Judicial Magistrate, Madathukulam, by allowing this Civil Revision Petition. ORDER
It is rather unfortunate that the learned Judge has closed an application for contempt by stating that the suit is ripe for trial totally loosing sight of the fact that orders of Court are alleged to have been flouted. Therefore, the order dated 21.08.2024 closing the petition namely I.A.No.9 of 2024 is set aside and the matter is remitted back to the learned District Munsif, Coimbatore. The learned Judicial Magistrate, Madathukulam, shall first consider this application and pass orders. This orders have been passed by consent of both the parties. 2.Accordingly, this Civil Revision Petition is allowed with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
