ORDER

Learned counsel for the petitioner would submit that though the 1st accused company was convicted by the trial Court, the respondent who was its Director was acquitted mainly on the ground that no notice was issued to the respondent and the said finding is contrary to the settled position of law laid down by the Hon'ble Supreme Court in (2015) 8 SCC 28 - Krishna Texport and Capital Markets Limited V. ILA A.Agarwal and others.

2.The point raised by the petitioner requires consideration. Hence, leave granted to file an appeal.

3. Registry is directed to number the above appeal and post it for admission if the papers are otherwise in order.
