ORDER

Apprehending arrest in connection with Crime No.334 of 2024 registered for the offences punishable under Section 379 of IPC, the present petition has been filed seeking anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused committed theft of RRU two numbers of Cell Phone Tower. Hence, the case.

3. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

4. The case of the prosecution as putforth by the learned Government Advocate (Crl.Side) appearing for the respondent is that the accused committed theft of RRU two numbers of Cell Phone Tower. He would further submit that the petitioner has four previous cases pending against him in Crime No.335 of 2024 for the offence punishable under Section 303(2) of BNS, in Crime No.367 of 2024 for the offence punishable under Section 379 of IPC, in Crime No.368 of 2024 for the offence punishable under Section 379 of IPC and in Crime No.299 of 2024 for the offence punishable under Section 379 of IPC. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Having heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record and taking into consideration of the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
