ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 23.08.2025, seeking bail in Crime No.70 of 2025, registered for the offence punishable under Sections 318, 64(2)(a), 49, 296(b), 115(2) and 351(3) of BNS and Section 4 of TNPHW Act.

2. The allegation against the petitioner is that the petitioner/A2 is the

friend of A1. The defacto complainant had developed relationship with A1/Delip Kumar, due to which, she became pregnant and it was intimated to A1 and he started to harass her. On the date of the occurrence, A1 took the defacto complainant to the lonely place and attacked her and the petitioner/A2 and A1 joined together forced the defacto complainant to commit unnatural offence. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that this is the second bail petition filed by the petitioner. He further submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He has not committed any offence as alleged in the FIR. He further submitted that the petitioner is in custody from 23.08.2025 and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, the learned counsel prays for grant of bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are two accused in this case, petitioner is A2 . A1 is still absconding and the petitioner is also involved in unnatural sexual offence. The defacto complainant was also pregnant both the accused have forced the defacto complainant to unnatural sexual offence. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioner has involved in unnatural sexual assault on the victim and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
