The petitioner, who was arrested and remanded to judicial custody on 21.09.2025, for the offences punishable under Section 123 of BNS and 24(1) of Cigarette and other Tobacco Products Act in Crime No.24 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on 21.09.2025, while the respondent police were on their routine patrol duty, the accused persons/ A1 and A2 were found in illegal possession of banned tobacco products such as 1330 packets of Vimal, 160 packets of Ganesh, 293 packets of Cool Lip, 590 packets of Hans, totalling to 350 kilograms of banned tobacco products; that upon investigation, it is revealed that the petitioner is also involved in he offence. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case, based on the confession of the co-accused and he is in judicial custody since 21.09.2025. He further submitted that there is no seizure of contraband from the petitioner and he is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and stated that there are totally four accused involved in this case and the petitioner is arrayed as A3; that A1 to A3 are the workers of A4, who purchase banned tobacco products from Bangalore and with the help of A1 to A3, sell the contraband to general public for personal gain. He further submitted that the total quantity of contraband involved in this case is 350 kilograms; that the petitioner has one previous case of similar nature; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the previous antecedents of the petitioner, huge quantity of contraband involved in this case and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 10.10.2025 stn 3/4
