Respondents Habeas Corpus Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Habeas Corpus to call for the entire records from the second respondent in connection with order Cr.M.P.No.46/Drug Offender/2025 C1, dated 19.08.2025 and quash the same and produce the petitioner's husband, namely Mukesh, S/o Udhayakumar, aged 23 years, now confined in Central Prison, Coimbatore under the Tamil Nadu Act 14 of 1982 before this Court and set him at liberty.

ORDER
(The Order of the Court was made by P.Velmurugan, J) Learned Additional Public Prosecutor appearing for the respondents submitted that the detenu has previous cases, but there is no adverse case against him. He further submitted that they have refused to receive the 2 / 5
detention order, but however, it is not stated specifically as to whom it was attempted to be served and refused. There is discrepancy in receiving the particulars. Hence, for the above reasons, this Habeas Corpus Petition is allowed, quashing the impugned order dated 19.08.2025. The detenu Mukesh, son of Udhayakumar, is directed to be set at liberty forthwith, unless he is required in connection with any other case.
