This Criminal Revision Case has been filed to call for the records relating to the order passed by the learned Metropolitan Magistrate for exclusive Trial of CCB cases ( Relating to cheating cases in Chennai) and CBCID Metro cases, Egmore, Chennai in Crl.M.P.No.12700 of 2025 dated 25.09.2025 and set aside the same.
2. The respondent police has registered a case in Cr No.143 of 2025 under Section 318(4) and 351(3) of BNS. Pursuant to the registration of the FIR, the respondent seized the petitioner's vehicle BMW X 1 CarRegistration No.TN 14 AJ 0004 White Colour Shaded Pin- with RC book Therefore, the petitioner filed a petition seeking return of the vehicle and the same was dismissed on the ground that there was a money dispute between the petitioner and the complainant and the petitioner failed to return the money.
3. The learned Government Advocate (Crl.Side) appearing for respondent raised strong objections for return of the vehicle.
4. Heard the learned counsel appearing on either side and perused the 2/6
materials available on record.
5. A perusal of the records reveals that the Vehicle was seized by the respondent police from the petitioner and the same was deposited before the Trial Court. It is alleged that the petitioner have received more than Rs.12,00,000/- stating that he will complete the work within a specified period. But the petitioner did not complete the work. Hence, this Court directs the petitioner to deposit a sum of Rs.12,00,000/- to the credit of Cr.No and the same may be withdrawn by the defacto complainant.

On such payment being made, the learned Metropolitan Magistrate for exclusive Trial of CCB cases ( Relating to cheating cases in Chennai) and CBCID Metro cases, Egmore, Chennai is directed to return the vehicle to the petitioner. Accordingly, the order 25.09.2025 made in Metropolitan Magistrate for exclusive Trial of CCB cases ( Relating to cheating cases in Chennai) and CBCID Metro cases, Egmore, Chennai is hereby set aside. The learned Metropolitan Magistrate for exclusive Trial of CCB cases ( Relating to cheating cases in Chennai) and CBCID Metro cases, Egmore, Chennai is directed to return the vehicle to the petitioner, forthwith on the following conditions:- (i) the petitioner shall execute a personal bond for a 3/6
sum of Rs.50,000/- (Rupees Twenty fifty Thousand only) to the satisfaction of the concerned Magistrate to the credit of Cr No.143 of 2025 pending on the file of the respondent police.
(ii) the petitioner shall deposit the original invoice or bill of the vehicle before the concerned Magistrate. (iii) the petitioner is directed to deposit a sum of Rs.12,00,000/-to the credit of Cr No.143 of 2025 in Metropolitan Magistrate for exclusive Trial of CCB cases ( Relating to cheating cases in Chennai) and CBCID Metro cases, Egmore, Chennai within a period of four weeks from today. Failing which, the order passed by this Court shall stand automatically cancelled. On such payment being made the defacto complainant is permitted to withdraw the amount after following due process of law.
(iv) the seized items should be photographed at the cost of the petitioner herein and a list is to be prepared and the same is to be signed by the petitioner.
(v) the petitioner shall not alienate and shall not make any alteration in the mobile.
(vi) the petitioner shall produce the mobile before the Court and the respondent police as and when required; (vii) If any of the conditions are violated, this order automatically stands cancelled.
