O R D E R
The petitioners, who were arrested and remanded to judicial custody on 17.07.2025 by the respondent police in connection with Crime No.39 of 2025 for the offences punishable under Sections 5(f) r/w 6 of POCSO Act 2012, seek bail.
2.The case of the prosecution is that, in the year 2022, when the de-facto complainant, was studying in the 7th standard, when the school was closed for a holiday, the accused persons, who were wardens of the hostel attached to the school, are alleged to have committed sexual assault on the victim. Hence the present case has been registered. 3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioners.
4.The learned Government Advocate (Crl.side) submitted that the petitioner was arrested on 17.07.2025, and the investigation is not yet completed. He further submitted that the petitioners have also been detained under Act 14 of 1982.
5. Considering the fact that the investigation is still pending and the allegations levelled against the petitioners are of a very serious nature, this Court is not inclined to grant bail to the petitioner at this stage.
