The petitioners herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 329(4) of BNS and Section 3 of TNPPDL Act and Section 4 of TNPHW Act, 2002 in Crime No.435 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners are neighbours of the defacto complainant and they had quarrel with the defacto complainant. On 29.09.2025 at about 02.00 a.m., the relative of the defacto complainant visited the house of the defact complainant and at that time, petitioner along with other accused trespassed into the house of the defacto complainant and damaged the properties. Hence, the complaint.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the 2/4

respondent police reiterated the prosecution case and submitted that, investigation is pending.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the manner in which the occurrence had taken place and the fact that huge property belongs to the defacto complainant has been damaged by the petitioners at night hours, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal Original petition is dismissed. 13.10.2025 sma 3/4
