The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS in Crime No.452 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 29.09.2025, while the respondent police were on their routine patrol duty, they found that the petitioner was involved in illegal transportation of 1/4 unit of river sand in a bullock cart; that on seeing the police, the petitioner fled away from the spot leaving the bullock cart and sand. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he was not involved in the above said offence. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner has no previous cases; that the petitioner excavated the sand from the cheyyar river; and that the investigation of this case is pending.

5. Considering the facts and circumstances of this case, taking note of the fact that the sand was illegally taken from river, thereby damaging the river bed, affecting the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.
