O R D E R

The petitioners, who were arrested and remanded to judicial custody on 31.08.2025 by the respondent police in connection with Crime No.441 of 2025 for the offence punishable under Section 81 of Juvenile Justice Act, seek bail.

2.The case of the prosecution is that the petitioners joined together and decided to engage in child trafficking for the purpose of selling the child and making money. Accordingly, with the help of A1, they trafficked a child from Karnataka and, after paying a huge amount, received the child. While attempting to sell the baby, they were caught red-handed by the police. Hence, the present case. 3.The learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in the case. He further submitted that they have been in custody since 31.08.2025, the child has already been rescued, and their further detention is not necessary. Hence, he prays that the petitioners may be enlarged on bail. 4.The learned Government Advocate (Crl.side) submitted that

there are totally three accused in this case. The first petitioner is the main accused who brought the child from Karnataka and handed it over to the second petitioner. So far, A1 is absconding, and the identity of the victim girl is yet to be established by the police. He further submitted that the first petitioner has a bad antecedent and is involved in one previous case, while no previous case is pending against the second petitioner. Hence, if the petitioners are released on bail, they are likely to commit similar offences.

I have also gone through the report and the statements recorded from the accused, which reveal that the petitioners were involved in child trafficking by collecting a huge amount and bringing the child, who was later rescued by the police. Further, the investigation disclosed that A1, the main accused, is still absconding.

6. Considering the nature of the offence and the stage of investigation, if the petitioners are released on bail, there is a possibility of their committing similar offences. Hence, I am not inclined to grant bail to the petitioners.

7. Accordingly, this Criminal Original Petition is dismissed.
