ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 448 and 397 of the Indian Penal Code. The incident occurred on 18.04.2001. The accused is said to have entered into the de facto complainant's house and robbed a gold chain. The property was recovered and handed over to the de facto complainant. Now, the whereabouts of the de facto complainant are not known. It is represented on behalf of the respondent Police that the accused is also not residing in the address and is elusive and the matter is pending for the past 24 years. The report of the Probationary Officer also states that the accused is not in a particular place ans is absolutely not traceable. 3. Accordingly, the case in P.R.C.No.9000015 of 2018 of Judicial Magistrate Court No.III, Tiruppur, Tiruppur Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
