ORDER
This Criminal Original Petition has been filed to issue directions to the respondents not to harass the petitioners under the guise of enquiry.
2. The case of the petitioners is that one Ramasamy, who is the father of the 1 st petitioner, allotted 1/3 rd share to the 1 st petitioner, while he was alive.
After the death of 1 st petitioner's father, the brothers of the 1 st petitioner demanded the 1 st petitioner to sign the blank stamp papers, while so, the 1 st petitioner gifted her property to her son, viz., 2 nd petitioner. The said settlement deed was executed on 15.11.2024, while so, the brothers of the 1 st petitioner, by abusing their official capacity with the help of the respondents-police threatening and harassing the petitioners to cancel the said settlement deed. Hence, this petition.
3. The learned Additional Public Prosecutor appearing for the respondents, on instructions submitted that current paper enquiry is pending against the petitioners and the petitioners were called for enquiry and the respondents have not harassed the petitioners.
4. In such view of the matter, it is for the investigating agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on such notice, the petitioners shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the respondents shall register the First Information Report and proceed as per law.
5. With the above direction, this Criminal Original Petition is disposed of.
