ORDER

This Criminal Original Petition has been filed by the petitioners, who were arrested and remanded to judicial custody on 10.02.2025, seeking bail in Crime No.10 of 2025 registered for the offences under Sections 8(c) r/w 22(c) & 29(i) of the NDPS Act, 1985 @ under Sections 8(c) r/w 22(c) and 29(1) of the Narcotic Drugs & Psychotrophic Substances Act, 1985. 2.The allegation against the petitioners is that the petitioners joining hands with two other accused involved in transportation of the 249 grams of Methamphetamine (commercial quantity). The case of the prosecution is that on 09.02.2025 at about 8.15 am., the respondent police have received an information regarding the transportation of Methamphetamine and it was deduced into writing and at about 9.00 pm.

, the police went to the Walltax Road entrance of the Central Railway Station and on the identification of the informant, A1 was intercepted and from him 21 grams of Methamphetamine was recovered.

3.The learned counsel for the petitioner submitted that already A1 in this case was granted bail by this Court in Crl.RC.No.1934 of 2025 dated 16.10.2025. She further submitted that this petitioner have been falsely implicated in this case, hence she prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent reported that totally there are four accused in this case, A1 was granted bail on statutory bail and that ground is not applicable to the case of the petitioner herein and the final report was also filed and the same is taken on file in C.C.No.639 of 2025 on the file of the 1st Additional Special Judge for EC and NDPS Cases, at Chennai. The petitioners were found in possession of commercial quantity, thereby he opposed for grant of bail to the petitioners. 5.Admittedly, the petitioners are in custody from 10.02.2025. Since the contraband seized was a commercial quantity and the petitioners have not

satisfied the twin conditions imposed under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioners at this stage and accordingly, this criminal original petition is dismissed. 30-10-2025 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes
