ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in Cr.No.348 of 2013 was registered for the alleged offences under Sections 2 (f) (iv) (v) (vi) (vii), 2 (i) of Motor Spirit and High Speed Diesel (Prevention of Malpractice in Supply and Distribution) order 2005 r/w Section 7 (i) a (ii) of E.C. Act, 1955. The incident occurred on 21.11.2013. The allegation in this case is that the accused were found to be transporting 2000 litres of diesel in violation of the Rules. There are totally seven accused in this case. It is seen that some of the accused attending and for some of the accused summons has not been served and some of the accused warrant has been pending. It can be seen that the offence took place in the year 2014.

There are no previous or subsequent cases against the accused. 3.Considering the nature of the allegation, the antecedents of the accused and since there is no likelihood of any meaningful trial being conducted and no useful purpose would be served by keeping the matter pending.

4.Accordingly, the case in C.C.No.310 of 2019 of Judicial Magistrate Court No.I, Villupuram Taluk, Villupuram, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
