ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case in Cr.No.668 of 2010 dated 10.04.2010 is registered for the alleged offence under Section 379 and 411 of the Indian Penal Code, 1860. The accused has previous criminal antecedents. Some of the earlier cases filed against him have ended in acquittal and some are still pending. However, it is submitted that the accused is presently leading a lawful life and has not involved himself in any further offences. The offence in this case is of a serious nature and the accused is said to have been involved in such activities for a considerable period of time.

3. In view of the above facts, this Court finds this to be an extraordinary case and has taken it up for disposal. It is reported that the stolen property has already been recovered and returned to the defacto complainant. It is further submitted that the accused has been regularly attending the Court proceedings. The defacto complainant is present before this Court and has stated that he does not wish to pursue the case any further.

4. Considering the factual matrix, context of the case, any further continuance of trial would impinge upon the accused's right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely and no useful purpose would be served.

5. Accordingly, the case in C.C.No.1100261 of 2017 on the file of Fast Track Court (Magistrate Level), Tiruvannamalai Taluk, Tiruvannamalai shall stands quashed and this Suo Motu Transfer Case stands disposed of. 17.10.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
