ORDER
The petitioner apprehends arrest for the alleged offence under Section 306 of Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No.130 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4

The allegation against the petitioner is that while working as a domestic maid in the house of the defacto complainant, she had allegedly committed theft of a sum of Rs.40,00,000/- (Rupees Forty Lakhs only) from the house of the defacto complainant. Hence, the present complaint has been registered.

The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

The learned counsel appearing for the intervener submitted that the petitioner had stolen a large sum of money from the house of the defacto complainant, and the stolen amount has not been recovered so far. Hence, she strongly opposed to grant anticipatory bail to the petitioner. 5.
The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and strongly opposed for granting anticipatory bail to the petitioner. He submitted that the petitioner, while working as housekeeper in the defacto complainant's house, had allegedly taken away a sum of Rs.40 Lakhs. He also submitted that the petitioner is 2/4
absconding, the investigation is still in progress, and the stolen money has not been recovered. He also brought to the notice of this Court that the earlier anticipatory bail application filed by the petitioner in Crl.O.P.No.26404 of 2025 was dismissed by this Court on 25.09.2025, and there is no change in circumstance thereafter.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl Side) for the respondent as well as the learned counsel appearing for the intervener. Perused the materials available on record. 7.
This being the second application for anticipatory bail, and taking into consideration the facts and circumstances of the case, the nature and gravity of offence committed by the petitioner, and the amount involved in this case, and the fact that there is no change in circumstance since the dismissal of the earlier petition, this Court finds no ground to grant anticipatory bail to the petitioner.
