ORDER

This petition has been filed under Section 34 of the Arbitration and Conciliation Act, 1996, challenging the impugned Arbitral Award, dated 08.11.2023.

2. When the matter is taken up for hearing today, both the counsels on instructions submitted that the parties have arrived at an amicable settlement. To that extent, a joint memo, dated nil.08.2025, enclosing the settlement agreement dated 14.08.2025, has been filed before this Court, which has been signed by the petitioner and the respondent and also by their learned counsel.

3. Based on the joint memo filed by the parties, the learned counsel for the respondent seeks permission of this Court to withdraw the amount of Rs.15,00,000/- which is lying to the credit of this Court. The learned counsel for the petitioner submitted that for withdrawal of the said amount, the respondent will have to file a payment out application and if such an application is filed, the learned counsel for the petitioner will state no objection in the said application.

4. Accordingly, this Arbitration Original Petition is disposed of in terms of the joint memo dated nil.08.2025 and the same shall form part of this order. The respondent is granted liberty to file a payment out application for withdrawal of Rs.15,00,000/- that is lying to the credit of this Court.
