O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A), 4(1)(C), 4(1A)(ii) TNP (Amendment) Act 2024 r/w Section 123 of BNS in Crime No.42 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that on 05.04.2025, while the respondent police were on their routine patrol duty near Earakumpattu Village, they found that the accused persons were involved in illegal selling 18 nos. of Bangalore Whisky (90ml each); that on seeing the police, one of the accused fled away from the spot and the respondent police arrested A1; that upon confession of the arrested accused/ A1, the petitioner has been implicated in this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he was not involved in the above said offence. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner has 20 previous cases; and that the investigation of this case is pending.

5. Considering the facts and circumstances of this case, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
