O R D E R
The petitioners, who apprehend arrest by the respondent police for the offences punishable under Sections 115(2), 351(1) of BNS r/w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.675 of 2025 seek anticipatory bail.

2.Earlier this Court, by order dated 15.09.2025, dismissed the bail application of the petitioner. After such dismissal, without change in circumstances, the present petition is filed. However, the learned counsel for the petitioner submitted that the first petitioner was arrested and released on bail and hence prays to grant anticipatory bail to the second petitioner, namely Sangeetha.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police has not objected to the same.

Considering the submissions made by the learned counsel on both sides, the fact that the second petitioner is a lady and that the majority allegations are attributed against the first petitioner, who was already released on bail, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate, Ambattur, on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties, each for a like sum to the satisfaction of the 2/5
respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall report before the respondent police, everyday at 10.00 a.m., for a period of one week and thereafter as and when required for interrogation;
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
