PRAYER: This criminal miscellaneous petition has been filed under Section 439(1)(b) of Cr.P.C.,/483 (1) (b) of BNSS Act/ 528 of the BNSS Act, to modify the condition imposed as that the petitioner may be directed to appear before the Judicial Magistrate Court - II, at Alandur every Friday at 10.30 a.m., for a period of 4 weeks and thereafter as and when required for interrogation" instead of "the petitioner shall report before the respondent police on every Saturday at 10.00 a.m., for a period of four Page No.1 of 4

weeks and thereafter as and when required for the interrogation" in Crl.O.P.No.30243 of 2024 dated 05.12.2024.

ORDER

The petitioner seeks modification on the condition in para no.7(a) imposed by this Court in Crl.O.P.No.30243 of 2024 dated 05.12.2025.

2. The Government Advocate (Crl.Side) for the respondent police, submitted that the petitioner has not complied with the condition even once.

3. In response, the learned counsel for the petitioner submitted that the petitioner had complied with the condition since he apprehends arrest in another case by the respondent.

4. This Court is of the view that condition cannot be modified on that ground. Hence, the criminal miscellaneous petition is dismissed. 10.03.2025 dk To 1.The Inspector of Police, Adambakkam Police Station, Chennai.
