ORDER

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records on the file of the respondents with respect to the proceedings on the file of the first respondent in SA/1780/2023 and the order dated 22.04.2024 and quash the same as illegal, invalid and non-est in the eyes of the law, since the same is not in accordance with law and direct the first respondent to conduct fresh proceedings upon the appeal filed by the petitioner. 2.The learned counsel appearing for the petitioner submitted that the petitioner made application under the Right to Information Act with the second respondent on 21.11.2022 seeking the report of the Chief Engineer with respect to the violations committed by TNEB in installing the transformer dated 04.11.2022; the report of the vigilance team, TNEB who had visited the site in August, 2022; the communication, notice or official memorandum issued by the Director, Distribution, TNEB to the Executive Engineer, TNEB Tambaram to install the transformer in violation of the existing rules and regulations for the

installation of the transformer; the copy of the authority approval and sanctioned copy and P.O. with respect to the transformer along with the serial number, date, month and year of the transformer installed abutting the petitioner's property; a copy of the Government Order or the Approval of the authority issued by the Director, Distribution, TNEB to the Executive Engineer, Tamil Nadu Electricity Board to provide electrical connection to illegal and constructions on Buddar Street; details with respect to the total number of Electricity connections and the load details along with the flat door numbers; total number of EB commercial lines connected on Buddar Street and load details along with flat door numbers.

3.The learned counsel appearing for the petitioner further submitted that since there was no reply for the said application, the petitioner filed appeal on 23.12.2022 and since there was no response, the petitioner filed second appeal before the first respondent on 27.01.2023, pursuant to which, the second respondent issued reply dated 23.06.2023 to the petitioner, however, no information sought for by the petitioner was furnished to the petitioner, however, the first respondent based on the said reply concluded the second appeal and passed the impugned order dated 22.04.2024. 4.The learned Standing Counsel appearing for the respondents 2 and 3 submitted that the petitioner specifically asked for the report of the Chief

Engineer with respect to the violations committed by TNEB in installing the transformer dated 04.11.2022, however, such report is not available with the respondents and further submitted that the respondents will provide the information available with the respondents and the same was also furnished to the learned counsel appearing for the petitioner before this Court today. 5.Recording the same, this writ petition is closed.
