O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS, 2023 and section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.186 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 10 cubic feet of sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the gravity of the offence committed by the petitioner and investigation is pending, there is likelihood that petitioner involve in similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.
