ORDER
(Order of the Court was made by R.Subramanian J.) By our order dated 19.07.2024, while imposing a cost of Rs.1,00,000/- on the State, we have directed a recovery of the said sum from the salary of the
second respondent in the Writ Appeal.
2. The second respondent/petitioner is before us seeking modification of the order regarding payment of cost. When the matter came up yesterday, the learned counsel appearing for the petitioner in this miscellaneous petition represented that the second respondent/petitioner would pay the cost from and out of his pocket so that recovery proceedings could be avoided.
3. Hence, we adjourned the matter today. Today, when the matter was called, the learned counsel for the second respondent/petitioner has produced a Bank challan to show that a sum of Rs.1,00,000/- to the credit of the account of the appellant in the Appeal.
4. In view of the said deposit, the last four sentences in paragraph 27 of the order dated 19.07.2024, which read as follows: "The State is therefore, directed to pay cost of Rs.1,00,000/-
to the petitioner/appellant within a period of four weeks from today. If it is so advised or if it is so desired the State can recover the costs from the salary of the second respondent who passed the order impugned in the Writ Petition."
are modified as follows:
The second respondent/petitioner will pay the cost of Rs.1,00,000/- and the said payment shall not have any effect on the Service Records of the second respondent.
