Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the respondents herein to survey the property comprised in SF No.233/1 of Seelanaickenpatti village, Dhadagapatti, Salem District and issue separate patta in the name of the legal heirs of the deceased Palanisamy based on the sale deed dated 04.06.1992 and by considering the representations of the petitioner dated 10.10.2024 and 04.07.2025 within a reasonable time as fixed by this Honble Court. 1/4

O R D E R
This writ petition has been filed for issue of a writ of mandamus directing the respondents to act upon the application submitted by the petitioner and to survey the subject property for subdivision and issue separate patta in the names of legalheirs of the deceased Palanisamy.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.
3. The case of the petitioner is that the subject property was originally purchased by the petitioner's father Palanisamy through a sale deed dated 04.06.1992. On his demise, the petitioner and other legalheirs inherited the subject property. A joint patta was also issued in their names. The petitioner wanted to conduct a survey for subdivision of the subject property and to issue separate patta in the name of all legalheirs of the deceased Palanisamy. Hence, representations dated 10.10.2024 and 04.07.2025 were made in this regard. Since the same were not considered, the present writ petition has been filed before this Court. 2/4

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the first respondent to act upon the representations submitted by the petitioner on 10.10.2024 and 04.07.2025 and take a decision on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. If there are any other interested parties, they shall also be put on notice before a final decision is taken.
