O R D E R

The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS, 2023 and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.216 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners was found in illegal transportation of 2 bags of river sand. Hence, the complaint.

3. The learned counsel appearing for the petitioners submitted that the petitioners is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioners has no previous cases.

5. Heard the learned counsels on either side and perused the materials 2/4

available on record.

6. Considering the gravity of the offence committed by the petitioners and the fact that the investigation is early stage, and if the bail is granted, they would indulge in similar offence, this Court is not inclined to grant anticipatory bail to the petitioners.
