This Writ Petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 06.09.2022 and dispose the same within the time frame fixed by this Court. 2.The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property and was in peaceful possession and enjoyment of the same. While so, the 2nd respondent issued a notification under Section 3A of the National Highways Act, 1956 for acquisition of lands for public purpose, viz., for widening and formation of four-lane highway in National Highway No.844. The Petitioner's lands were included in the acquisition proceedings. Subsequently, the 2nd respondent passed an Award dated 02.09.2022 fixing the land value at Rs.191.94 per square metre, awarding a total compensation of Rs.16.39.929/-. Aggieved by such fixation, the petitioner filed an Appeal in the form of representation dated 06.09.2022 to the 1st respondent seeking enhancement of 2/5
compensation. As the same did not evoke any response, the present writ petition has been filed.
3. The learned Additional Government Pleader appearing for the respondents would submit that the respondent concerned will consider and pass orders on the application of the petitioner, within the stipulated time fixed by this Court.
4. Heard both sides. Perused the records.
5. Considering the facts and circumstances of the case and having regard to the submissions made, without going into the merits of the case, this Court directs the respondent concerned to pass orders on the representation of the petitioner dated 06.09.2022, on merits and in accordance with law, after giving notice to the petitioner and after affording an opportunity of hearing to the petitioner and any of the interested parties, within a period of eight weeks from the date of receipt of a copy of this order.
