ORDER
This petition has been filed forbearing the 1st respondent from opening the tender documents in respect of tender notice No.19/2025-2026/ SDO dated 06.09.2025 of the 1st respondent herein in respect of the work of widening from Construction of High Level Bridge at Km. 6/2 of Nailam -Pondy road to NH 45 (via) Thennalapakkam-Padirapulyur road without issuing the certificates to the petitioner and receiving the bids of the petitioner.
2. It is the case of the petitioner that the petitioner, a registered class-I Highways Department. The first respondent issued a tender notice dated 06.09.2025 for widening and strengthening work widening from construction of High Level Bridge at KM6/2 of Nailam Pondy Road to NH 45 Thennalapakkam - Padirapulyur Road. As per the caluse 8 of the tender conditions, the work site inspection certificate and the working condition of plants & Machineries certificate from the second, which were mandatory pre qualification documents. Applications for issuance of these certificate were to be submitted on or before 22.10.2025. A formal representation dated 06.10.2025 was sent by the petitioner requesting inspection and issuance of the necessary certificates, but no action was taken. Hence, the petitioner has filed the above said writ petitions.
3. The learned counsel for the petitioner submitted that the second
respondent being a public authority, who is duty-bound to process the representation within the prescribed time-lines. The last date for submitting the application is 22.10.2025. Therefore, this Court may direct the 3rd respondent to issue work site inspection certificate and working condition of the plants and machineries certificate to the petitioner by today itself.
5. The learned Special Government Pleader submitted that the certificates will be issued to the petitioner on 13.10.2025 during the office hours.
6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.
7. Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the second respondent to issue work site inspection certificate and working condition of the plants and machineries certificate to the petitioner in both the cases on 14.10.2025 before 5.00 P.M. The petitioner shall collect the same during office hours.
8. With the above directions, the writ petitions are disposed. No costs. Consequently, connected miscellaneous petitions are closed. 10-10-2025 Rli
